Dr. Rapacki is an independent intelligence analyst and consultant who receives and disseminates critical intelligence and policy information from and to law enforcement, intelligence operatives, homeland security officials, government and community leaders. Obama Serves 14-State Governors with Warnings of Arrest for Treason

President Barack Obama had served 14-State Governors in the United States, National Security Letters (NSLs) warning that the Governor’s actions in attempting to form “State Defense Forces” needs to be halted “immediately” or they will face arrest for the crime of treason. The employment of NSLs was authorized by the Patriot Act introduced by George W. Bush. Contained within the section related to these letters, it is forbidden for anyone receiving a NSL warning to even acknowledge the existence of said communication.

Obama is angered by the several State Governors who have reestablished “State Defense Forces.” These forces are described as: “State Defense Forces (also known as State Guards, State Military Reserves, State Militias) in the United States are military units that operate under the sole authority of a state government; they are not regulated by the National Guard Bureau nor are they part of the Army National Guard. State Defense Forces are authorized by state and federal law and are under the command of the governor of each state. State Defense Forces are distinct from their state’s National Guard in that they cannot become federal entities.”

Mr. Obama is fearful of these State Defense Forces, in that he does not have control of said forces, and with the U.S. Military stretched to near breaking from multiple deployments and theatre actions in Iraq and Afghanistan, these State military forces would be under the direct command and authority of the Governors in which states have said forces. In essence, the Governors would have “de facto control” of the United States.

The two Governors leading this move are: Tim Pawlenty, Governor of Minnesota; and Rick Perry, Governor of Texas. Both of these State Governors stated they have: “…deep fear the President is destroying their Nation.” Governor Pawlenty’s fear of Obama is that since Obama took office he has appeased America’s enemies and has shunned some of America’s strongest allies, especially Israel. Governor Perry has declared that Obama is punishing his State of Texas by dumping tens-of-thousands of illegal Mexican immigrants into the cities and small towns of Texas. Governor Perry further recently stated: “If Barack Obama’s Washington doesn’t stop being so oppressive, Texans might feel compelled to renounce their American citizenry and secede from the union.”

Obama fearing a revolution against him by the states, has moved swiftly by nationalizing nearly all National Guard Forces in multiple states; Georgia, Alabama, Kansas, Minnesota, Tennessee, Virginia, Louisiana, South Carolina – to name a few. The Governors of the Great States of Alabama, Georgia, Louisiana, South Carolina, Tennessee, Texas, and Virginia still have under their Command-and-Control the State Defense Forces to go against invasion should the need arise. Also important to note: There are NO U.S. laws prohibiting National Guard troops from also joining their State’s Defense Forces, and many do. This dilemma occurred during the Civil War with many “citizen soldiers” choosing to serve their states instead of the Federal Government.

This is a fluid and still developing situation that warrants close attention.

Notice that what ‘angers’ Obama, an illegal alien usurper of the Presidency, is some states are starting to realize that a “well regulated Militia is necessary to a FREE state.”

Although Texas is mentioned as having a Home Guard, to my knowledge, it is but 2 Battalions of MP’s and very ill-equipped. I do not know the strength or condition of the Home Guards of the other states mentioned.

It is obvious to anyone, who has studied the constitution, that the Federal government is intent upon destroying the constitutional militia, and has been since 1903, and I suspect long prior to that, when the National Guard was officially formed. The militia is now vilified, ridiculed, demonized and pilloried as white supremacist, racist, anti-government and terrorists. Ladies and gentlemen, look in the mirror and ask yourself how you became all these things because, you ARE the militia.

What happened to;

To provide for calling forth the militia to execute the laws of the union, suppress insurrections and repel invasions;

To provide for organizing, arming, and disciplining, the militia, and for governing such part of them as may be employed in the service of the United States, reserving to the states respectively, the appointment of the officers, and the authority of training the militia according to the discipline prescribed by Congress (US Constitution, Article I section 8 clause 14 & 15)?

The Federal government is charged with providing for and provisioning the militia, not destroying it. That is TREASON and it has been ongoing through administration after administration, both Republican and Democratic.

No, it is not treason to restore the militia but it is treason to destroy it!

May I take this opportunity to share some thoughts and insights regarding a recent briefing paper I wrote revealing Mr. Obama’s oppressive move against 14-Governors who took steps to develop State Defense Forces’ and bringing those forces under the Command-and-Control of a Governor invoking his Constitutional right to establish State Sovereignty. My paper was quickly removed from a well known site shortly after appearing, and this has led to all sorts of speculation.

My briefing paper was not “scrubbed” because of some sordid reason. I became aware of an issue in the content of my report, and wholeheartedly endorsed removing the report. The government did not threaten any action. I was not nor was the site coerced into removing the report. I became aware that the sensitivity of the material was of such a nature that unless I could produce actual National Security Letters I referenced, it would be better to remove the report. I could not produce these, and I realized the information could easily be questioned and discarded as another reactionary conspiracy theory gone amuck. This would be a shame. The information and the seriousness of the actions reported on should not be so quickly dismissed no matter how uncomfortable we become. Some of the information was already public (from other sources) prior to my distributing this briefing. I did not want to add any confusion to the subject matter, and I did not want the subject to be easily dismissed by not being able to produce the specific letters of warnings.

I think events would have worked out well, except more attention was paid after the removal of my report. Being that my report was so quickly pulled allowed people’s minds to flirt with the gambit of possibilities, hence, this more personal letter and explanation. There was no nefarious or calculated reason other than what I have shared.

Another reason I wanted to reach out to folks across our Nation is to thank you (and them) for a tremendous influx of emails showing support and kindness – even graciousness by a few who disagreed with my findings. Even in disagreement, I was taken back by the kind points made, the absence of personal attack, the remaining on point to mutually look at troubling information and times. I really sensed the couple of individuals who took offense, or found fault, also hold a deep desire to see our country come away from the bitter and divisive means that have become routine by elected officials who forget they are “representatives” of us – WE THE PEOPLE; whether as President, Senator, Congressman – or as Mayor of our communities.

There was a much larger segment who wrote supportively. Some were worried about me personally even though we had never met. Some were concerned the paper had been “scrubbed” because of content. Some just wanted to write and demonstrate support for those who are attempting to expose the darkness covering much of America today. One of the first things you used to learn in boot camp is the Posse Comitatus Act, which was created 200 years ago to make sure the military was never used against the citizens. But, for all practical purposes, this law has now been completely negated through Executive Orders issued by Presidents Clinton, Bush and Obama(1).

The more of the report I read, the clearer it became that over many years the bureaucrats in Washington, Republican and Democrat alike – were carefully maneuvering for an eventual silent coup… one that would never make headlines but would result in the transfer of power from the American people to a secret group of wealthy bankers who already had everything they wanted… except total power.

Shortly thereafter, I left my job and began making plans to prepare for what I see as a martial law lockdown or perhaps even a complete military takeover. The last one, H.R.645 was part of the plan I had read before and actually calls for Homeland Security to build no fewer than 6 national facilities for holding civilians. Trust me when I tell you that there is a plan in place for the suspension of all Constitutional Rights of Americans. The plan includes “interning” certain segments of the population if such a national emergency arises.

Almost daily you’ll find headlines telling the same story… and these are in establishment publications! The manuscript I had received ‘unofficially’ has now been rewritten to avoid security issues and copyright problems. It’s also been condensed to eliminate the fluff, tightly edited to deliver the more essential material and then finally republished with some very obvious pro-freedom observations.

•Martial Law was declared by General Andrew Jackson during the War of 1812

•President Lincoln declared it again during the War Between the States, arresting anyone who dissented from his war-time policies, including newspaper editors and legislators!

•In 1931, Texas Governor Ross used National Guard troops to enforce limits on the size of private property!

•Much of the Pacific Coast was under martial law after the attack on Pearl Harbor.
Even worse, our country already has a history of the domestic use of the armed forces without a declaration of martial law.

•In 1871, President Grant sent troops into South Carolina to confiscate all private guns.

•In 1914, President Wilson ordered the infantry into Colorado to disarm everyone involved in a labor union dispute, including members of law enforcement and the National Guard.

•In 1993, the US Army provided advice, tactical support and military equipment to the FBI and the BATF to raid the Branch Davidian Compound in Waco, TX, resulting in the deaths of 74 men, women and children
In the first 130 years of our country’s history, federal troops were used more than 100 times without a declaration of martial law! True, the situation has been well prepared on and off for the past century, especially the past twenty years. The initial testing ground was conducted upon our Holy Russia and a bloody test it was. The final collapse has come with the election of Barack Obama. His speed in the past three months has been truly impressive. His spending and money printing has been a record setting, not just in America ’s short history but in the world. That is correct, dear reader, in the land of “pure” free markets, the American president now has the power, the self-given power, to fire CEOs and we can assume other employees of private companies, at will. Come hither, go dither, the centurion commands his minions.

So it should be no surprise, that the American president has followed this up with a “bold” move of declaring that he and another group of unelected, chosen stooges will now redesign the entire automotive industry and will even be the guarantee of automobile policies. I am sure that if given the chance, they would happily try and redesign it for the whole of the world, too. Prime Minister Putin, less then two months ago, warned Obama and UK ’s Blair, not to follow the path to Marxism, it only leads to disaster. Apparently, even though we suffered 70 years of this Western sponsored horror show, we know nothing, as foolish, drunken Russians, so let our “wise” Anglo-Saxon fools find out the folly of their own pride.

Again, the American public has taken this with barely a whimper…but a “free man” whimper.

So, should it be any surprise to discover that the Democratically controlled Congress of America is working on passing a new regulation that would give the American Treasury department the power to set “fair” maximum salaries, evaluate performance, and control how private companies give out pay raises and bonuses? Senator Barney Frank, a social pervert basking in his homosexuality (of course, amongst the modern, enlightened American societal norm, as well as that of the general West, homosexuality is not only not a looked down upon life choice, but is often praised as a virtue) and his Marxist enlightenment, has led this effort. He stresses that this only affects companies that receive government monies, but it is retroactive and taken to a logical extreme, this would include any company or industry that has ever received a tax break or incentive.

The Russian owners of American companies and industries should look thoughtfully at this and the option of closing their facilities down and fleeing the land of the Red as fast as possible. In other words, divest while there is still value left.

The proud American will go down into his slavery without a fight, beating his chest, and proclaiming to the world, how free he really is. The world will only snicker.

From the beginning of the American Republic there has been a group of influential people who have devoted their lives and careers to putting more Power In Government (PIGs). As soon as the American Revolution ended Alexander Hamilton schemed to overthrow the first Constitution, the Articles of Confederation, and replace it with a document that would legitimize a permanent president who would appoint all the governors and have veto power over all state legislation. He wanted a king, in other words, who could force British-style mercantilism and an imperialistic foreign policy on America without any significant resistance by the citizens of the states. He failed during his lifetime, but that is essentially the system Americans live under today. We now live in “Hamilton’s republic,” as his idolaters gleefully remind us.

As soon as Hamilton’s party, the Federalists, gained power, one of the first things they did was to rescind the First Amendment to the new Constitution with the Sedition Act during the presidency of John Adams. Hamilton authored several long-winded reports as Treasury Secretary in which he invented the insidious notions of “implied” powers in the Constitution along with such an expansive interpretation of the General Welfare and Commerce Clauses that the Constitution would become useless as a restraint on governmental tyranny.

Hamilton’s political compatriot, Chief Justice John Marshall, turned Hamilton’s legalistic mysticism into legal precedent during his long tenure on the Court, with many other PIG lawyers following suit over the succeeding generations. And of course Abraham Lincoln established a French Revolutionary/Stalinist-style regime that imprisoned tens of thousands of Northern political dissenters, employed an army of spies and informers (on Northern citizens), shut down hundreds of opposition newspapers, illegally suspended habeas corpus, deported an outspoken member of the opposition party, confiscated firearms, illegally created the state of West Virginia, censored all telegraph communication, and myriad other assaults on the Constitution, including waging war on his own country after promising to defend the lives and liberties of the very people he was waging war on.

The brilliant John C. Calhoun explained the inevitability of all of this – and more – in his Disquisition on Government, written in the late 1840s and published shortly after his death in 1850. Calhoun wrote that it is an error to think that “a written constitution, containing suitable restrictions on the powers of government, is sufficient, of itself, without the aid of any organism . . . to counteract the tendency of the numerical majority to oppression and the abuse of power.”

All democracies are broken down into two basic groups – net taxpayers and net tax consumers, said Calhoun. And the latter group (PIGs) will inevitably prevail, as history teaches us. The party in favor of constitutional restrictions on governmental power at first “might command some respect” but “would be overpowered.” It is mere folly, he argued, to suppose that “the party in possession of the ballot box and the physical force of the country [i.e., the military], could be successfully resisted by an appeal to reason, truth, justice, or the obligations imposed by the constitution.” Moreover, “the end of the contest [between net taxpayers and tax consumers] would be the subversion of the constitution” whereby “the restrictions [on state power] would ultimately be annulled, and the government be converted into one of unlimited powers.”

This is why Calhoun embraced the Jeffersonian idea of nullification during the sectional dispute over the 1828 “Tariff of Abominations.” As explained by Ross Lence in the Foreword to Union and Liberty: The Political Philosophy of John C. Calhoun, the former vice president was “seeking a means by which [disunion] could be avoided,” and so he “turned to the doctrine of interposition, which defended the right of a state to interpose its authority to overrule federal legislation. The seeds of this doctrine were introduced by Thomas Jefferson and James Madison in the Kentucky and Virginia Resolutions of 1798 and 1799.” Of course, such ideas as nullification, interposition, secession, and federalism were snuffed out by the Lincoln administration as a result of the War to Prevent Southern Independence.

Calhoun’s prediction of a government of unlimited powers eventually came true. The Jeffersonian strict constructionists did more or less prevail for a while, but were nearly wiped out by 1865, and were nowhere to be found by the turn of the twentieth century. At that point numerous notorious PIGs gleefully thumbed their noses at the Constitution and the freedoms it was supposed to protect. This story is told in great detail in the new book by Tom Woods and Kevin Gutzman entitled Who Killed the Constitution? The Fate of American Liberty from World War I to George W. Bush.

Woodrow Wilson resumed the totalitarian attacks on free speech that Adams and Lincoln had pioneered with the Espionage Act of 1917 and the Sedition Act of 1918. These laws literally criminalized opposition to going to war in Europe, as Woods and Gutzman explain. In addition, the creepy-sounding “Committee on Public Information” portrayed Germans “as subhuman savages”; and sauerkraut even became known as “liberty cabbage,” an early precedent for the moronic “freedom fries” language adopted by the Bush administration after its invasion of Iraq in 2003 when the French government refused to participate.

During the Lincoln administration roving gangs of Republican Party thugs destroyed printing presses, intimidated Democratic voters in the Northern states, and generally behaved like twentieth-century brownshirts. Woods and Gutzman write of how the exact same thuggish behavior was an integral part of the Wilson administration. A Christian minister was sentenced to 15 years for distributing a pamphlet to five people explaining that Jesus Christ was a pacifist (reminiscent of how Congressman Ron Paul was loudly booed by an audience of “evangelicals” when he reminded them in 2008 that Jesus was known as The Prince of Peace). Men were tarred and feathered for not spending enough of their income on “Liberty bonds” that helped fund the war; German language Bibles were burned; and the producers of a movie about the American Revolution that portrayed America’s “ally” Great Britain in an unflattering light were sentenced to ten years in prison.

By the 1950s American presidents clearly thought of themselves as dictators who were not constrained one iota by the Constitution. Consequently, Harry Truman felt justified in having the government seize and operate the steel mills so that he could better prosecute the undeclared war in Korea. Truman insisted that he had absolute, dictatorial power to “do whatever is for the best of the country.” Constitution schmonstitution. The Supreme Court eventually ruled against this particular act of theft, but it had little effect in deterring future dictatorial behavior. Today, American presidents think of themselves not just as unrestrained dictators but as emperors of the world.

Woods and Gutzman provide a scholarly analysis of why Brown vs. Board of Education was unconstitutional. The Supreme Court “set itself above the Constitution” for what the majority believed was a good cause. Constitution schmonstitution.

There is no constitutional authority for the myriad pork-barrel spending projects that Congress funds year in and year out with tax dollars, but so what? Woods and Gutzman describe the evolution of this particular power grab, from the time when the “father of the Constitution,” James Madison, vetoed an “internal improvements” bill as unconstitutional to today’s anything-goes mentality in Washington, D.C.

Then there is the theft of privately-held gold by FDR. The Supreme Court never even bothered to comment on this grossly unconstitutional act of thievery. Nor is there any constitutional basis for the government’s ban on prayer in public schools or military conscription. Not to mention the dictatorial implications of presidential “executive orders.” Teddy Roosevelt receives special mention with regard to this latter authoritarian tool. He issued 1,006 executive orders compared to 51 and 71 for his two predecessors, write Woods and Gutzman. The “Bush Revolution,” discussed in chapter 12, proves that modern American presidents and their advisors have nothing but absolute contempt for the Constitution.

Upon reading Who Killed the Constitution? the Jeffersonian wing of the founding fathers, were they alive today, would be reaching for their swords, preparing for another revolution. The Hamiltonians, on the other hand, would be popping champagne corks, high five-ing each other, and smiling very broadly. Calhoun would be deeply saddened that his dire predictions about the fate of an American democracy that is stripped of its Jeffersonian, states’ rights moorings have all come true in spades.

JCT Confirms Failure to Comply with Democrats’ Mandate Can Lead to 5 Years in Jail

Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail. The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.

In response to the JCT letter, Camp said: “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail. It is outrageous and it should be stopped immediately.”

Key excerpts from the JCT letter appear below:

“H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]
